May 25, The bin Laden Raid and its Legal Framework
The debate over whether activities fall under Title 10, governing the armed forces, or Title 50, governing intelligence activities, comes up in a variety of contexts, including targeted killings and cybersecurity. The raid on Osama bin Laden's compound earlier this month is just the latest chapter in this debate. Why was it a Covert Action instead of a Clandestine Operation — what’s the difference and why should we care? On May 25, the Reserve Officers Association and the American Bar Association's Standing Committee on Law & National Security will host a panel discussion on this timely issue. The panel will begin with a recap, followed by a discussion among experts on military law, intelligence law, international law, and the Constitution to discuss the legal framework.
